Moonvalley's Prohibited Use Policy
This Prohibited Use Policy (this “Policy”) supplements the Moonvalley Terms of Service (the “Terms”) and applies to your access to and use of the Services, Inputs you provide to the Services, and your use of Outputs you create through the Services. Defined terms used in this Policy have the meanings set forth in the Terms.

Eligibility and Capacity Requirements You must be at least 13 years old to use our Services. If you are under 18, you must have parental consent. Users must have the legal capacity to enter into binding agreements and comply with applicable laws in their jurisdiction.
Prohibited Content
You may not use the Services to input, post, store, generate, or share any Content that:
Is illegal or violates, infringes, or misappropriates third-party rights, including but not limited to Content that:
Is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, or fraudulent;
Would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party or otherwise create liability, or violate any local, state, national, or international law or regulation;
May infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party (including, for example, any Inputs – whether images, videos, or text prompts -- that contain or that instruct the Services to generate materials that infringe on such rights);
Contains any private or personal information of a third party without such third party’s consent;
Promotes, encourages, or facilitates illegal products (including illegal drugs, weapons, or other dangerous materials) or illegal services (including human trafficking, sexual services, and gambling) or that advertises regulated products or services (including medical devices, pharmaceutical products, tobacco, and alcohol) without Moonvalley’s prior written approval and all proper licenses, certifications, and clearances;
Solicits money, cryptocurrencies, non-fungible tokens, or other assets from other users; or
Contains any unsolicited promotions, political campaigning, advertising, or solicitations or otherwise promotes or facilitates the distribution of spam.
Is abusive or harmful, including but not limited to Content that:
Is violent, hateful, defaming, disparaging, or harassing, including Content that constitutes, depicts, threatens, incites, facilitates, celebrates, or promotes: (1) violence, hate, harassment, intimidation, terrorism, discrimination, or threatening or stalking conduct of or against an individual or group (including groups based on social behaviors or protected characteristics like race, national or ethnic origin, religion, age, sex, gender, sexual orientation, and physical ability); (2) sexual conduct, violence, or exploitation, including sexually explicit Content involving minors or that promotes or threatens the sexualization or grooming of children; (3) self-harm, including eating disorders and suicidal behaviors; (4) bullying (including cyberbullying), shaming, defamation, disparagement or humiliation; or (5) interference with democratic processes (including disinformation campaigns);
Is gory, explicit, or otherwise disturbing (including detached human or animal body parts, cannibalism, shootings, bombings, and infectious diseases);
Targets or exploits the vulnerabilities of a specific group based on age, social, physical, or mental characteristics in a manner likely to cause that person or another person physical or psychological harm (for example, by confronting minors with mature themes, including sexual content, graphic violence, substance abuse, and obscenity, or otherwise exploiting, harming, or attempting to exploit or harm minors);
Contains any viruses, corrupted data, or other harmful, disruptive, or destructive files or content; or
Significantly disrupts the platform experience for other users or creates substantial legal or safety risks for Moonvalley or the community, as determined through our content review processes.
Is fraudulent or misleading, including but not limited to Content that:
Contains or depicts any statements, remarks, or claims that do not reflect your honest views and experiences or that manipulates, defrauds, or deceives others, including with respect to: (1) the time, place, means, or eligibility requirements for voting (or Content that propagates false claims that could materially discourage voting); and (2) the existence, provenance, or diagnosis of medical or psychological conditions;
Impersonates, or misrepresents your affiliation with, any person or entity (including political candidates, elected government officials, and celebrities for non-satirical purposes);
Purports to provide personalized medical, financial, legal, or other professional advice as a substitute for consulting qualified professionals (general educational information is permitted with appropriate disclaimers);
Is designed to be used for the administration of justice, law enforcement, immigration or asylum processes, or to predict an individual’s propensity to commit an act; or
Is designed to compromise security or gain unauthorized access to computer systems or networks, including spoofing or social engineering.
High-Risk Applications You may not use our Services for applications involving critical decision-making in:
Medical diagnosis, treatment decisions, or health assessments
Legal proceedings, law enforcement, or judicial decisions
Financial decisions with significant personal or institutional impact
Critical infrastructure, safety systems, or emergency response
Automated decision-making that affects individual rights, benefits, or opportunities
Educational or research use in these domains may be permitted with appropriate disclaimers and safeguards.
We evaluate potential violations based on context, intent, and likely real-world outcomes. Content that might otherwise be restricted may be permissible for legitimate educational, artistic, research, or journalistic purposes with appropriate safeguards.
For clarity, you may not use the Services in ways that cause or are likely to cause harm to individuals, groups, or society, including but not limited to content or uses that:
Physical harm: Content that could lead to violence, injury, endangerment, or unsafe behaviors (e.g., instructions for dangerous activities, incitement to violence, promotion of self-harm)
Psychological harm: Content designed to harass, intimidate, cause emotional distress, or exploit vulnerabilities
Social harm: Content that undermines democratic processes, spreads dangerous misinformation, incites discrimination, or damages community trust (e.g., election disinformation, conspiracy theories, coordinated harassment campaigns)
Legal harm: Uses that violate laws, infringe on others' rights, or create legal liability
Prohibited Uses of the Services
You may only use the Services if you are eligible to do so and only for their intended purpose in accordance with the Terms. You may not, in connection with the Services:
Use our Services for any illegal or unauthorized purpose, or engage in, encourage, or promote any activity that violates the Terms, this Policy, applicable law, contract, intellectual property or other third-party rights, or commit a tort;
Use the Services or Outputs in ways that undermine the sustainability of our platform or create unfair competitive advantage, including but not limited to: (a) systematic extraction of our capabilities to replicate our service; (b) using Outputs to train competing AI systems without authorization; or (c) large-scale automated usage that degrades service quality for other users;
Modify our Services, remove, obscure, crop out, or modify any proprietary rights notices or markings associated with our Outputs or our Services (including watermarks), or otherwise make any derivative works based upon our Services;
Use the Services or any Outputs therefrom to compete with Moonvalley, including to research or develop competitive products, models, or services or to benchmark the Services or the Outputs against other products, models, or services;
Developer Responsibilities If you build applications or services using our platform, you must:
Implement appropriate content filtering and safety measures for your specific use case
Provide clear disclosure to end users that AI-generated content is involved
Monitor your application for misuse and implement reasonable safeguards
Take responsibility for how your application uses our Services
Monitoring and Enforcement
We use automated systems and human review to detect policy violations. Violations may result in warnings, content removal, account restrictions, or termination. Repeat violations will result in permanent account termination.
Appeals Process: If you believe your content was incorrectly restricted, you may request human review by contacting [email protected]. Include context about your intended use and why you believe the content serves a legitimate purpose.
These guidelines may evolve based on emerging risks, technological developments, and observed outcomes from platform use. We will provide notice of material changes to this Policy.
